Le <br \/>Groupe d\u2019experts s\u2019est r\u00e9uni entre le 10\u00a0mars et le 4\u00a0mai 2021 et a \u00e9cout\u00e9 les expos\u00e9s, examin\u00e9 les documents et d\u00e9lib\u00e9r\u00e9 sur les solutions de rechange aux sanctions p\u00e9nales pour la possession simple de substances contr\u00f4l\u00e9es. <strong>Ce groupe a conclu que la criminalisation de la possession simple cause des pr\u00e9judices et doit cesser.<\/strong> Le Groupe d\u2019experts a tenu compte de cinq questions fondamentales lorsqu\u2019il a formul\u00e9 ses recommandations\u00a0: la stigmatisation, les pr\u00e9judices disproportionn\u00e9s subis par les populations victimes d\u2019in\u00e9galit\u00e9s structurelles, les pr\u00e9judices caus\u00e9s par le march\u00e9 des drogues illicites, le fardeau financier sur les syst\u00e8mes de sant\u00e9 et de justice p\u00e9nale, et les affections sous-jacentes non trait\u00e9es.<\/p>\r\n<p>Le Groupe d\u2019experts a \u00e9galement tenu compte des obligations du Canada en vertu de trait\u00e9s internationaux, des le\u00e7ons apprises dans d\u2019autres pays, de l\u2019important enjeu qu\u2019est la s\u00e9curit\u00e9, des services de soutien pour la collectivit\u00e9, des r\u00e9cents d\u00e9veloppements dans le cadre de la <em>Loi r\u00e9glementant certaines drogues et autres substances<\/em> et du cadre juridique dans son ensemble.<\/p>\r\n<\/div>\r\n<\/div>\r\n\r\n\r\n\r\n<h4 class=\"wp-block-heading\"><strong>Le Groupe d\u2019experts a formul\u00e9 les recommandations suivantes relatives \u00e0 la d\u00e9criminalisation et la r\u00e9glementation\u00a0:<\/strong><\/h4>\r\n\r\n\r\n\r\n<ol class=\"wp-block-list\">\r\n<li>Le Groupe d\u2019experts recommande \u00e0 l\u2019unanimit\u00e9 que Sant\u00e9 Canada mette fin aux sanctions p\u00e9nales pour possession simple et la plupart des membres recommandent que Sant\u00e9 Canada mettent fin \u00e0 toutes les mesures coercitives li\u00e9es \u00e0 la possession simple et \u00e0 la consommation.<\/li>\r\n<li>La plupart des membres du Groupe d\u2019experts recommandent que le gouvernement du Canada entame imm\u00e9diatement un processus de modification l\u00e9gislative afin de rassembler la\u00a0<em>Loi r\u00e9glementant certaines drogues et autres substances<\/em>\u00a0(LRCDAS), la\u00a0<em>Loi sur le tabac et les produits de vapotage<\/em><em>\u00a0<\/em>(LTPV), la\u00a0<em>Loi sur le cannabis<\/em>\u00a0et toute autre loi f\u00e9d\u00e9rale pertinente dans un m\u00eame cadre juridique en mati\u00e8re de sant\u00e9 publique compos\u00e9 de structures r\u00e9glementaires sp\u00e9cialement adapt\u00e9es aux diff\u00e9rents types de substances.<\/li>\r\n<li>Le Groupe d\u2019experts recommande que les seuils de possession simple soient fond\u00e9s sur la pr\u00e9somption d\u2019innocence et qu\u2019ils soient fix\u00e9s \u00e0 un niveau suffisamment \u00e9lev\u00e9 pour repr\u00e9senter les habitudes d\u2019achat et de consommation de toutes les personnes qui consomment des drogues.<\/li>\r\n<li>Dans le cadre de la d\u00e9criminalisation, le Groupe d\u2019experts recommande que les casiers judiciaires provenant de d\u00e9lits ant\u00e9rieurs pour possession simple soient enti\u00e8rement expurg\u00e9s. Inscrivez-vous \u00e0 notre newsletter pour obtenir des mises \u00e0 jour et d\u00e9couvrez comment vous pouvez agir avec nous.<\/p>\r\n<!-- form.123formbuilder.com script begins here --><script type=\"text\/javascript\" defer=\"defer\" src=\"https:\/\/form.123formbuilder.com\/embed\/6415583.js\" data-role=\"form\" data-default-width=\"650px\"><\/script><!-- form.123formbuilder.com script ends here -->\r\n<\/div>\r\n\r\n\r\n\r\n<h4 class=\"wp-block-heading\"><strong>En outre, le Groupe d\u2019experts formule les recommandations connexes suivantes\u00a0:<\/strong><\/h4>\r\n\r\n\r\n\r\n<ol class=\"wp-block-list\" start=\"5\">\r\n<li>Le Groupe d\u2019experts recommande que le Canada r\u00e9alise d\u2019importants investissements visant \u00e0 fournir un \u00e9ventail complet de services de soutien aux personnes qui consomment des drogues ou des substances ou qui sont en r\u00e9tablissement.<\/li>\r\n<li>Le Groupe d\u2019experts recommande la mise en \u0153uvre d\u2019un syst\u00e8me plus d\u00e9taill\u00e9 et mieux adapt\u00e9 afin de recueillir, d\u2019utiliser et de diffuser plus rapidement et plus efficacement des donn\u00e9es probantes sur la consommation de substances et ses effets, et sur les r\u00e9percussions des politiques gouvernementales sur la sant\u00e9 et le bien-\u00eatre des Canadiens.<\/li>\r\n<li>Le Groupe d\u2019experts encourage vivement Sant\u00e9 Canada \u00e0 respecter les droits souverains des peuples autochtones du Canada et \u00e0 aider leurs gouvernements \u00e0 fournir les m\u00e9thodes de pr\u00e9vention et de traitement appropri\u00e9s.<\/li>\r\n<li>Le Groupe d\u2019experts recommande que Sant\u00e9 Canada mette sur pied un nouveau comit\u00e9 compos\u00e9 de personnes ayant v\u00e9cu ou vivant une exp\u00e9rience concr\u00e8te de la consommation de substances afin de fournir des conseils sur la mise en \u0153uvre de ses recommandations.<\/li>\r\n<\/ol>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>RAPPORT 2 : <a href=\"https:\/\/drugpolicy.ca\/wp-content\/uploads\/2021\/08\/HC-Task-Force-Report-2-FR.pdf\" target=\"_blank\" rel=\"noopener\">Recommandations relatives \u00e0 la politique du gouvernement du Canada en mati\u00e8re de drogues, telle qu\u2019elle est \u00e9nonc\u00e9e dans le projet de Strat\u00e9gie canadienne sur les drogues et autres substances (SCDAS)<\/a><\/strong><\/p>\r\n<ul>\r\n<li>\r\n<p><span style=\"color: #c31424;\"><strong>Recommandation principale (r\u00e9glementation l\u00e9gale) : <\/strong>\u00ab\u2009inclure en tant que priorite\u0301 fondamentale de la SCDAS l\u2019e\u0301laboration et la mise en \u0153uvre imme\u0301diates d\u2019un cadre unique de sante\u0301 publique compose\u0301 de re\u0300glements pre\u0301cis couvrant l\u2019ensemble des substances, y compris les drogues actuellement illicites ainsi que l\u2019alcool, le tabac et le cannabis.
