{"id":19448,"date":"2023-09-20T09:02:21","date_gmt":"2023-09-20T16:02:21","guid":{"rendered":"https:\/\/drugpolicy.ca\/?p=19448"},"modified":"2023-09-26T10:36:45","modified_gmt":"2023-09-26T17:36:45","slug":"local-and-national-organizations-report-proposed-barrie-public-space-bylaw-to-united-nations","status":"publish","type":"post","link":"https:\/\/drugpolicy.ca\/fr\/local-and-national-organizations-report-proposed-barrie-public-space-bylaw-to-united-nations\/","title":{"rendered":"Local and national organizations report proposed Barrie public space bylaw to United Nations"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Barrie, ON |&nbsp;<\/strong>September 20, 2023<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One day after Barrie City Council\u2019s&nbsp;community safety committee heard presentations on a controversial proposed public space bylaw,&nbsp;local and national organizations have sent it to the United Nations Rapporteurs on Homelessness and Extreme Poverty for review.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Canadian Drug Policy Coalition and Pivot Legal Society&nbsp;<a href=\"https:\/\/candrugpolicy.nationbuilder.com\/r?u=ho-FIph9D5C32C1IykbbLm9AVt55o4PyQ8MPj8MXPkBweYyOEfZoPVMkokXHQy-sJ329PAHA-UYyx3R62NAxFxpM9TUIZAPLi47ptDeSpS_0PI01xLaXONRfWKAp80sJBmDsLb5kbTm7kW7DkGLKt1o4IkXUvQOC-huGvz7BJJ7NHJtVGYA-CU1_hrS-m-Of&amp;e=455e64dc0d4faca49920f7512fbbe6cc&amp;utm_source=candrugpolicy&amp;utm_medium=email&amp;utm_campaign=press_release_barrie_bylaw_sep&amp;n=2&amp;test_email=1\">filed the report today<\/a>, with endorsements from&nbsp;Barrie Housing and Homelessness Justice Network, Indigenous Harm Reduction Network and the Gilbert Centre,&nbsp;in response to a UN call for submissions on laws and policies that criminalize and punish people in poverty and homelessness. In the report, advocates and policy experts point to Barrie\u2019s proposed bylaw as a particularly egregious example of public space legislation and policy in Canada endangering people living in homelessness and poverty, particularly those who are at risk of fatal drug poisoning.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThis bylaw targets unhoused people and their ability to survive,\u201d said Sarah Tilley of the Gilbert Centre. \u201cIt effectively criminalizes being homeless &#8212; and interferes with the ability of us as outreach workers to carry out our potentially lifesaving work. Despite the public outcry and serious concerns from grassroots organizations and policy experts, the City of Barrie seems determined to move ahead with this harmful and ineffective approach.\u201d&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed bylaw amendment would introduce fines ranging from $500 &#8211; $100,000 for distributing food, water, clothing, shelter, or other essentials to assist people with sleeping or protection from the elements without authorization from the city of Barrie. It came to Barrie City Council in May and June 2023. Met with significant public opposition, including&nbsp;<a href=\"https:\/\/candrugpolicy.nationbuilder.com\/r?u=CaNtuHv5YBL_hDPpdi5djgkm61LONTPGocMXE2z30lnmUm-llzbFRQ02riA95PXrGKwEDo9tHzVt1rjeRv1umA&amp;e=455e64dc0d4faca49920f7512fbbe6cc&amp;utm_source=candrugpolicy&amp;utm_medium=email&amp;utm_campaign=press_release_barrie_bylaw_sep&amp;n=3&amp;test_email=1\">a public statement from the Office of the Federal Housing Advocate<\/a>, council referred the matter back to city staff for review and updates.&nbsp;&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThis is not the kind of international attention we want Barrie to receive,\u201d said Reverend Christine Nayler of Ryan\u2019s Hope. \u201cI am hoping to appeal to Council&#8217;s humanity and ask them to rethink these punitive bylaws that will harm our city&#8217;s most vulnerable residents, and to remind them that these proposed bylaws are a violation of the Charter of Rights and Freedoms. Passing bylaws that go against Charter Rights opens the city to legal challenges and will end up costing the city more than addressing the root cause of the issue: a lack of truly affordable and low-barrier housing. Investing dollars in prevention rather than punishment makes sense.\u201d&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In October 2021, the Canadian Drug Policy Coalition hosted health and social service workers, policy experts, people who use drugs, and other community members affected by the toxic drug crisis to discuss challenges and solutions. The&nbsp;<a href=\"https:\/\/candrugpolicy.nationbuilder.com\/r?u=VqZDZrLp8i4Ur4SY36LAaxojWNvx78B6RGBuRXe0I8tqCWTA4fHUnn8Awxvf6I4ixm6Tc7DojMo7cE3vsqzYQXU2OdaZLYeYfPD5_nfg2vI-GWcRjiELmeik7lZQ0ZCA&amp;e=455e64dc0d4faca49920f7512fbbe6cc&amp;utm_source=candrugpolicy&amp;utm_medium=email&amp;utm_campaign=press_release_barrie_bylaw_sep&amp;n=4&amp;test_email=1\">resulting report<\/a>&nbsp;identified six key recommendations for action, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>increased access to deeply affordable housing;&nbsp;&nbsp;<\/li>\n\n\n\n<li>funding for a lived experience advisory group to address the toxic drug crisis, and;&nbsp;<\/li>\n\n\n\n<li>the creation of multi-sectoral decision-making tables to support municipal policy development for the City of Barrie.<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cIn the Barrie dialogues, we heard the need for community-driven solutions that lift people up, rather than cause harm,\u201d said DJ Larkin, executive director of the Canadian Drug Policy Coalition. \u201cEvery person, regardless of their housing status or relationship to substances, should be able to access safety. The frontline services provided by Barrie\u2019s community organizations are part of that.
